The complaint against Neymar and the Chilean referee Bascuñán filed

The Peruvian Prosecutor's Office filed a complaint for alleged “generic falsehood” filed against the Brazilian star Neymar and the Chilean referee July
Bascuñán after the game that Brazil won 2-4 a Peru on October 13, on the second day of the qualifiers for the Qatar 2022 World Cup.

The decision was made in response to a lawsuit brought by an organization called the Association of Trial Lawyers of the Peru, which considered that Neymar committed a crime by “simulating” a foul and falling “intentionally” to be charged a penalty during the match, according to local media.

Bascuñán, for his part, he was accused of altering “the truth intentionally” with the presumed objective of favoring Brazil.

However, the incumbent provincial prosecutor of Lima Maria
of the
Pillar
Salazar decided “to declare there is no place to file a criminal complaint” against Neymar, Bascuñán and “those who are responsible for the alleged commission of the crime against public faith in the form of generic falsehood, to the detriment of the Peruvian fans and society.”

Consequently, it ordered “the preliminary file of the complaint and the cancellation of the data” of the implicated that had been consigned in the official files.

After hearing the decision, the Peruvian Trial Lawyers Association filed a complaint against the prosecutor, considering a “serious fact and law” decision that did not indicate “factual elements of the complaint” in its resolution.

He added that these elements “are duly tested” in a video published by the Conmebol, in which presumably “it can be demonstrated, if the objective and subjective assumptions of the criminal offense concur, this is the typical unlawful and guilty conduct.”

In this regard, the lawyer Gisela
Palaces, who is a member of the association, declared on the RPP Noticias radio station that the prosecutor acted “as a lawyer for the accused” by asking “that they delete” their names “from the system, because they” do not want to appear at the process. “

Palacios also assured that the attorney for Neymar he tried to approach them “through a third person” to offer them financial compensation in exchange for their withdrawal from their claim and expressed his suspicion because shortly afterwards they were notified of the complaint file.

While Brazil currently occupies the first place of the playoffs, with 12 points out of 12 possible in four games, Peru is located in the penultimate position, with only one unit, after having drawn 1-1 in the first day against Paraguay, after which they lost 2-4 to the Canarinha, 2-0 against Chile and 0-2 before Argentina.
