The Government has reached an agreement with ERC and PNV this Thursday so that temporary public administration workers with more than five years in the same position obtain a fixed position, without having to compete, through a merit contest protected in article 61.6 of the Law of the Basic Statute of the Public Employee (EBEP).
The agreement, reached by the groups of PSOE and United We Can with ERC and PNV, includes two additional provisions that oblige the Administrations to convene “by the contest system those places of a structural nature that have been occupied by temporary personnel “at least since January 1, 2016, counting five years from December 31, 2020, parliamentary sources have reported.
This represents a reduction to five years after the ten initially required by the Ministry of Finance to reduce the temporality in the Administration, thus leaving the door open for them to automatically consolidate their place.
The same sources have explained that interns from three to five years will require a “competition-opposition in which the exercises of the opposition may not be eliminatory“, while from five years onwards there will be a merit contest covered in article 61.6 of the EBEP.” The places that can be released by contest are not conditional on not having been previously summoned, “they added.
On the other hand, the agreement also includes that extend “explicitly” to public commercial companies, public business entities, public sector foundations and public sector consortia.
Likewise, the transitional provision that addresses the processes of 2017 and 2018 is modified. “It continues to be said that they have to be resolved before December 31, 2024 but the explicit reference to that” is eliminated. “will continue to run according to to the forecasts of the respective calls “”, they have indicated.
