The Superior Court of Justice of Madrid (TSJM) has annulled the acquittal of former soccer player Xabi Alonso for crimes against the Public Treasury and has ordered the return of the case so that a new sentence is issued by the same magistrates “in which the omissions that have determined the nullity are solved and a new legal motivation is resolved”.
All this after the Civil and Criminal Chamber of the Superior Court of Justice of Madrid has agreed partially uphold the appeals filed by the Public Prosecutor's Office and the State Attorney against Sentence 672/2019, of November 25, issued by Section 30 of the Provincial Court of Madrid, corresponding to the so-called 'Xabi Alonso case'.
At the end of November 2019, the Provincial Court of Madrid acquitted former soccer player Xabi Alonso of three crimes against the Public Treasury relating to the years 2010, 2011 and 2012 for which the Madrid Prosecutor's Office accused him for not paying taxes under the supposed appearance of a transfer of exploitation of image rights to a company.
The magistrates ruled against the position of the Prosecutor's Office by determining that it was “adjusted” to the tax regime and that the facts did not constitute a crime. The prosecutor requested five years in prison in his letter, but lowered the sentence request to two and a half years at the trial for having paid three million euros.
