The Prosecutor’s Office supports Errejón and resumes the investigation after the controversial stoppage by the defense of Elisa Mouliaá

The Madrid Prosecutor’s Office has supported the appeal presented by Íñigo Errejón against the indefinite suspension of the investigation against him, reactivating a judicial process that had been left in the air after the request of Elisa Mouliaá’s lawyer, Carla Vallto stop proceedings due to her maternity leave. The investigating judge of the case, Adolfo Carreterohas finally lifted the suspension, summoning both parties for January 16.

The origin of the case

The complaint filed by Elisha Moulia On October 24, 2024, Errejón was accused of an alleged sexual assault that occurred in September 2021 during a private party. That same day, Sumar’s former spokesperson in Congress resigned his membership as a deputy, distancing himself from institutional politics.

The case was assigned to the Court of Instruction number 47 of Madrid, where Mouliaá was summoned to testify on November 7. However, the actress’s defense requested the suspension of the process alleging the medical leave of her lawyer, Carla Vall, who was pregnant. The judge accepted the request, paralyzing the proceedings “sine die.”

Errejón’s reaction and the support of the Prosecutor’s Office

Íñigo Errejón’s defense described the suspension as a “procedural fraud” and presented an appeal that was endorsed by the Prosecutor’s Office. According to the Public Prosecutor’s Office, Vall’s request lacked legal basis because the lawyer was already on sick leave before assuming the representation of Mouliaá.

The Civil Procedure Law allows procedures to be suspended due to medical leave of the intervening lawyers, but this only applies to those who are already acting in the case. In this case, lawyer Vall had not yet intervened in the process at the time of her discharge.“, argued the prosecution in its report. Furthermore, the Criminal Procedure Law does not contemplate the general suspension of a criminal investigation due to illness of one of the parties.

The prosecutor stressed that an indefinite cessation of the case would seriously affect Errejón’s right to a trial without undue delay, a constitutional principle that protects both complainants and those investigated.

The judge’s decision and next steps

Judge Carretero, accepting the observations of the Prosecutor’s Office, reactivated the proceedings and summoned both parties for January 16. He also warned Elisa Mouliaá that, in the event that her lawyer cannot assume representation before that date, a lawyer from the victim assistance shift will be assigned to avoid further delays.

For the sake of legality and legal certainty, the statement will not be suspended unless there is justified cause, and this cannot be the lack of appearance of the lawyer.“, the judge ruled, making it clear that he will not tolerate new delays.

Controversial context

Mouliaá’s complaint joins a series of anonymous testimonies spread on social networks that accuse Errejón of alleged sexual attacks. In parallel, his defense has argued that these complaints seek to damage his reputation and hinder his ability to defend himself.

For her part, Elisa Mouliaá has maintained a discreet public profile since she filed the complaint, except for specific statements in which she has reiterated her intention to seek justice.

The hearing on January 16 will be key to determining the next steps in a case that has already captured the attention of public opinion and that promises to continue generating headlines in the coming months.
