The Judge of the National Court agrees with CAS, and therefore LaLiga, in the Fuenlabrada Case, as reported Iusport. This resolution supports that it is the institution chaired by Javier Tebas who has the powers, and not the RFEF, to decide whether Fuenlabrada should be demoted or not. not having been able to play against Deportivo on the last day of LaLiga SmartBank in the 2019-20 season.
In the Fuenlabrada case there was a conflict of powers between LaLiga and the RFEF. The LaLiga judge considered that there was no breach of the COVID protocol by Fuenlabrada, preventing the game from playing against Deportivo. So the game should not be considered lost and it would end up playing weeks later. On the other hand, the Federation organ proposed the descent of the Madrid club. Faced with this conflict of powers, the Administrative Court of Sports ruled in favor of LaLiga and the RFEF went to the ordinary courts.
Now, it has been the ordinary justice that has also ruled in favor of CAS and LaLiga. “The CAS resolution is fully correct as regards the competent body to hear the matter. […] There is a Protocol of action that regulates such issue in detail, being therefore, evident, that having been issued that Protocol by LaLiga, knowledge of the files that are instructed by alleged violations of the same corresponds to this and not to the RFEF ”Says the resolution.
