The 'Fuenlabrada case' comes to an end. The Higher Sports Council has rejected the request of Numancia and Deportivo de la Coruña to disqualify the president of LaLiga, Javier Tebas. The clubs, now in Second Division B, claimed this based on the controversy that arose on the last day of the Second Division championship, when it was decided to postpone the match between Depor and Fuenlabrada and keep the rest of the day scheduled on the scheduled day. Ultimately, the results fell to the two plaintiff teams, who considered the planning of the problem unfair. For this reason, they wanted to appeal until the last avenue in search of salvation or, at least, the legal payment of those responsible for what happened.
Both clubs accused the president of LaLiga abuse of authority, conflict of interest and breach of protocol, after the postponement of the clash on the same day that it had to be played at the same time as the rest of the day. They also denounced the relationship between Javier Tebas' son and Fuenlabrada, since he is secretary of the Board of Directors.
Today, Irene Lozano and her CSD team have shelved the case. This has been communicated through an official note:
“The CSD has rejected the request for precautionary disqualification of Javier Tebas by RC Deportivo de la Coruña and CD Numancia. The aforementioned complaints had to do with the trip to La Coruña by the Fuenlabrada CF team last July, and accused the president of the LNFP abuse of authority, very serious breach of the rules of the game due to adulteration of the competition, conflict of interest and non-compliance with the COVID 19 Protocol.
-The CSD resolution makes it clear that an abuse of authority by Tebas cannot be derived because it is not deduced from the documentation provided by the complaints that the Fuenlabrada trip exceeded the powers granted to the president of the LNFP.
-As for the adulteration of the competition, the resolution recalls that the agreement to suspend the Fuenlabrada-Deportivo match was adopted by the RFEF Competition Committee.
-Regarding the conflict of interest, the resolution states that it is difficult to evade the final result of the match (2-1 in favor of R.C. Deportivo), finally held on August 7, as to understand that the decisions could personally benefit Tebas.
Likewise, the resolution of the president of the CSD, as already done by the Social Discipline Judge of the LNFP and the Investigating Court of A Coruña, dismiss the accusation of non-compliance with the sanitary measures based on what was provided by the complaining clubs.
-Finally, the CSD resolution states that the publications made by the president of the LNFP in RRSS, to which the complainant refers, do not allow to deduce that they contain any meaning that represents an attack against sports dignity and decorum. And this because at no time are foul words, insults or derogatory words used for the president of R.C. Sports.
– Regarding the accusations made by the complainant based on various information that appeared in the media, in the opinion of the CSD they lack the necessary legal basis“.
