The judge orders the release of Djokovic

MADRID, 10 One. (EUROPA PRESS) –

Serbian tennis player Novak Djokovic, number one in the world, has won the appeal against the decision to deny him a visa in the Federal Circuit Court of Australia, for which he will be released after his retention in a Melbourne hotel and will be able to play the Open of Australia, first ‘Grand Slam’ of the season.

During the hearing, the judge asked the Australian Border Force to take “the necessary measures” to take this Monday “the applicant to the facilities specified by his lawyers.”

The hearing was delayed due to technical problems with the court’s video link, but Djokovic’s lawyers began to present his case to Judge Kelly, who asked the court “What else could this man have done?” And said. that he was “agitated” by the subject.

“Here, a professor and an eminently qualified physician provided the applicant with a medical exemption. On top of that, that medical exemption and the basis on which it was granted were provided separately by an additional independent specialist panel established by the state government of Victoria and that document was in the hands of the delegate, “Judge Kelly said.

Djokovic’s attorney, Nicholas Wood, argued that the notice of intent to cancel the visa was flawed because it was made on “a confusing combination of two reasons.” Australian government attorney Christopher Tran said Djokovic responded to the notice.

In court documents presented by Djokovic’s lawyers it was revealed that the player had been infected by COVID-19 in December 2021. The documents said that the contagion was the basis of Djokovic’s medical exemption.

The documents also noted that Djokovic expressed “shock”, “surprise” and “‘confusion” when notified of the cancellation of his visa “as he had done everything he was asked to enter Australia”.

But the Australian Department of the Interior produced court documents claiming that “there is no such thing as a guarantee of entry for a non-citizen to Australia”.
