The Provincial Court gives another judicial scramble to Al Thani

New judicial setback for the Al Thani family, who does not stop harvesting fresh rains in the legal field. The Provincial Court has dismissed the appeal where they wanted Richard Shaheen to be appointed as none other than judicial controller attached to the judicial administrator José María Muñoz. An attempt by the sheilh to have one of her own control as she pleased the man appointed by the judge to guide the club since February 21 for an extendable six-month period.

This is the statement. The Second Section, in a car dated 2/7/2020, bases its decision in the sense that. “The appellants' claim, that the judicial administration agreed in supplementary application of articles 630 and following of the Civil Procedure Law, cannot be given without the appointment of the corresponding auditor, must be rejected. And this, since the criminal nature of the agreed precautionary measure prevents Article 631.2 of the Civil Procedure Law from being applied in a restrictive manner. Not proceeding, the literal extrapolation of the regulatory precepts of the judicial administration in the event of a preventive embargo, to the present case. Without considering the appointment of a judicial controller, by the investigated, in order to make the agreed precautionary measure more effective. As the administrator's action is judicially intervened, the investigated have access to the actions that are being carried out by said administrator. Similarly, we cannot understand that the appointment of the financial controller indicated by the appellants is precise in order to facilitate the professional performance of the appointed judicial administrator. Well, without prejudice to the qualification of the proposed financial controller; what is not questioned neither by the appellants nor by the rest of the parties, is the qualification of the designated administrator, whose performance we reiterate, is supervised by the investigating magistrate. Being able, and owing, the designated administrator, to request all the necessary information for the correct development of the judicially entrusted work.

Already says the Spanish proverb. “Whoever sings badly sounds good to him.” Or “there's nothing like singing badly to sing a lot.” This is how it goes to the horrible president / tweeter and his idle children.
