Jail and fine to the head of the Treasury who swindled two ‘ex’ Atlético

The Court of Madrid sentenced to two years in prison and to pay a fine of 18.8 million euros to a head of Hacienda for defrauding more than six million thirty footballers and basketball players, keeping their tax returns, as well as eight years in prison for three lawyers involved in the plot.

The Chamber details that the penalty is imposed by virtue of article 8 of the Penal Codewhich allows prison sentences of up to three years and a fine of up to six times the benefit pursued, obtained or facilitated, and taking into account that it is “an official with a relevant position in the AEATwhose action involved obtaining a high benefit for the accused”

On the other hand, the three lawyers involved, Julio LV, Manuel VJ y Juan Ignacio TShave been sentenced to eight years in prison as authors of the continuing crimes of fraud and falsehood in public, official and commercial documents and of taking advantage of privileged information obtained from a public official, for which they must also pay a fine of 12,000 euros each.

In addition, the four convicted must compensate Hacienda with 6,138,797 euros plus the corresponding interest, and July MF y Juan Ignacio TS. must also compensate the public estate with 142,281 euros.

The sentence considers subsidiary civil liability to the mercantile Sports Advisors LAPVER SL -whose administrator is July MF– of the amount of 3,648,447.15 euros and Star Atletes Society SL -administered by Manuel VJ- for the amount of 1,399,609.92 euros.

PLAYERS FROM ATLÉTICO, MADRID, SEVILLA…

Among the affected footballers, none of them aware of the plot, are the former players of the Real Madrid Nuri Sahin y Hamit Altintop; ex-football players Atletico Madrid Edward Salvio y We have Pongolle; y Pierre Webo (Mallorca, Osasuna and Leganés), Marius Stankevicius (Seville, Valencia and Córdoba) or Emir Spahic (Seville).

As the sentence considers proven, between 2014 and 2016 the lawyers Julio LV and Manuel VJ., “in common agreement and with the purpose of enriching themselves”, they requested the Tax agency economic refunds to which several football and basketball players who had played professionally in Spanish teams could be entitled.

These refunds correspond to the difference between the personal income tax withholdings (income tax) and non-resident income tax installments (IRNA), which were those that corresponded to athletes, all foreigners.

On the other hand, Leonor SP, Deputy Head of Unit of Assistance and Tax Services of the AEAT and ex-spouse of the also accused Ignacio TS, accessed the necessary data to make the requests for return and transferred them to the rest of the convicts, details the sentence.

Through the information it provided, the lawyers were able to access the athletes’ retention certificates and data, the signatures they used while playing in spain –”that served to imitate them”– and other aspects of the employment and tax situation of the swindled.

The lawyers, using said information, obtained an “undoubted” economic benefit and deposited the money in different bank accounts that they used for investments and personal expenses.
