Provisional freedom for Rafael Amargo after being arrested for a crime of drug trafficking

The head of the Court of Instruction number 2 of Alicante has decreed the provisional release of Raphael Bitterafter being arrested 48 hours ago for an alleged crime of drug trafficking and attack on authority, following a complaint filed in July by his neighbors for an alleged sale of narcotic substances in his apartment on Calle Espíritu Santo in Madrid.

The magistrate has imposed as precautionary measures the obligation to appear on the 1st and 15th of each month before the Investigating Court number 27 of Madrid, which is competent in this investigation as it already has an open cause for these facts, as well as the prohibition leaving the country.

The judge has denied the avoidable pretrial detention with a bail of 6,000 euros that the Public Prosecutor requested for the detainee because she understands that “there is not such a high risk of flight” that this measure is essential, and there are “other alternatives” such as biweekly appearances and the prohibition to leave the national territory.

In this sense, the magistrate justifies her decision that the person under investigation “has already withdrawn his passport” by another Investigating Court in Madrid, where he is making biweekly presentations without any incident being recorded, and “has roots in Spain, where he is a character public, which makes it difficult for him to evade the action of Justice”.

In December 2020, the man from Granada was arrested along with his girlfriend, the Argentine Luciana Bongianino, and two other people for the alleged commission of a crime against public health for the alleged sale of narcotic substances to third parties in a “persistent” manner in exchange for money. The oral hearing will be held on the 7th, 8th, 9th and 12th at the Provincial Court of Madrid, according to legal sources.
