UEFA opens sanction proceedings against Real Madrid, Barça and Juventus

UEFA announces that it is opening a sanctioning file against Real Madrid, Barcelona and Juventus for their attempt to create a Super League outside of the highest continental body and the decision not to back down, something that the other nine founding clubs did. In a brief note he reported: “Following an investigation carried out by UEFA's ethics and discipline inspectors in relation to the 'Super League' project, disciplinary proceedings have been opened against Real Madrid CF, FC Barcelona and the Juventus FC for a possible violation of the UEFA legal framework. More information will be provided in due course. “

This is the next decisive step taken by UEFA to be able to sanction what it considers to be dissident clubs. After opening an investigation a few weeks ago, The fact of opening a file reflects that the investigators have found punishable evidence with which to punish the three clubs. We must remember that one of the possible sanctions that are considered would be to leave Madridistas, Catalans and Juventinos for two years without participating in European competitions.

The inspectors who have ordered the opening of a sanctioning file represent UEFA in the proceedings before the Control, Ethics and Disciplinary Body and the Appellate Body. There are 20 members and among them there is a Spaniard, Toni García Alcaraz, although he cannot take part in this process as there is a club of the same nationality involved.

Meanwhile, the position of the three named clubs remains clear. They take refuge in the courts to obtain the reason. In fact, a few days ago the commercial court number 17 of Madrid raised a preliminary ruling dated May 11 before the Court of Justice of the European Union (CJEU) to clarify whether FIFA and UEFA have a dominant position and abuse, as dictated by the order of April 20 by which the European Super League Company SL sued the two football organizations.

The order on which Madrid, Barça and Juventus take refuge “prohibits FIFA and UEFA that, during the processing of the main procedure, directly or indirectly (through their associate members, confederations, license clubs or national or domestic leagues) announce, threaten, prepare, initiate and / or adopt any disciplinary or sanctioning measures (or, directly or indirectly, incite or promote that said disciplinary or sanctioning measures be announced, threatened, prepared, initiated and / or adopted by third parties) in front of the clubs, managers and people of the clubs and / or players that participate in the preparation of the European Football Super League. “This would legally conflict with UEFA's intentions.
