This is the contract that some footballers make their lovers sign to avoid rape charges

For some footballers, kisses, intimate encounters or sexual games without a signature are over. Sex has become contractual for certain football stars, who, fearful of receiving a complaint for assault or rape by their lover after a sexual encounter, have decided to use a contract that stipulates the consent of the other signing party before any type of practice.

Thus, as this week he shared on his networks Miguel Galanpresident of the National Training Centre for Football Coaches, among some of the biggest stars in the first, second and even third divisions worldwide, a document is already being shared and used – with boxes to fill in that range from authorising touching to anal penetration with toys, including recordings or other practices – which would thus avoid any scandal or litigation after a night of passion.

But what some might see as a prudent preventive measure on the part of the players has not only been seen as a trap for women and their right to say “no” whenever they want, but also the contract that is already in force in the locker room has certain controversial clauses that have opened the debate and generated criticism among experts on sexual violence.

And the supposed contract shared by Galán in his X account includes a clause, the sixth, which contemplates the case of “accidental rape“, referring to non-consensual penetration that could occur spontaneously and unintentionally due to involuntary movements during sexual intercourse.

As expected, the document has been harshly questioned by many sectors, because the fact that a woman signs a consent before starting an act as free and spontaneous as sex cannot imply that she later does not want to refuse to participate in certain practices, that she wants to change her mind or that she even wants to stop. In fact, there are already experts who have stated that said document is “absurd” and which could never have a legal covering effect.

While some try to protect themselves in court, the truth is that the list of footballers convicted of sexual abuse continues to grow. This September, Valencia CF player Hugo Mallo has been sentenced to pay 7,000 euros (including the costs of the fine and compensation to the victim) for sexually abusing a woman who worked as a mascot for the club. There have been other high-profile cases before, such as that of Dani Alves -who was sentenced to four years and six months in prison for sexual assault for assaulting a woman in a Barcelona nightclub, although he was released after paying a bail of one million euros in March-; like that of the Celta player Saints Minawho in July 2023 was sentenced to 4 years in prison for sexually abusing a woman; or that of the three Arandina players Carlos Cuadrado, Victor Rodriguez and Raul Calvowho were sentenced to 38 years in prison – the sentence was eventually reviewed and reduced to nine years – for gang assaulting a 15-year-old minor whom they contacted on Instagram in November 2017.

Not forgetting the case of Ashraf JudgeHiba Abouk’s ex, accused of an alleged rape in France, or of the same Cristiano Ronaldowho in June 2009 was accused of rape by a woman, Kathryn Mayorga, in Las Vegas. Finally, a US court ruled in favour of the striker, dismissing the young woman’s claim, who in 2010 received 375,000 dollars from the Portuguese as a confidentiality contract, to maintain her silence. Eight years later, she wanted to take him to court again and filed a multi-million dollar lawsuit against the footballer, but the judge ended up rejecting it.
