The TSJM endorses the RFEF 2020 election call

The Fourth Section of the Contentious-Administrative Chamber of the Superior Court of Justice of Madrid has upheld the appeal filed by the Royal Spanish Football Federation (RFEF) to annul the resolution of the Administrative Court of Sport (TAD) that annulled the elections called by the federal body in 2020, the RFEF reported this Tuesday.

“The Superior Court of Justice of Madrid has notified the judgment of the Fourth Section of the Contentious-Administrative Chamber upholding the appeal filed by the RFEF and various members of the RFEF assembly; and annulling the resolution of the TAD that upheld various appeals and annulled the call for elections called by the Board of Directors of the RFEF in the year 2020. In addition, the ruling imposes the costs on the Administration,” the RFEF said in a statement.

On June 10, 2020, the RFEF Board of Directors agreed to call for elections to the General Assembly, its Delegate Commission and the presidency of the body for the month of August. However, on the 30th of that same month, the TAD annulled it due to procedural defects, partially estimating the appeals presented by the Royal Football Federation of Madrid (RFFM), by the footballer Sergio Marcos González (Cultural and Sports Leonesa) and by the Flat Earth and UD Los Barrios clubs.

The TAD had declared the call for the elections and the electoral calendar null and void, ordering the retroaction of the procedure to the moment prior to the call and forcing the elaboration of a new electoral calendar, because it had been carried out through the Federal Board of Directors, that he was not competent to do so. The TSJM already provisionally suspended that opinion in July 2020 and in September Luis Rubiales was re-elected.

For the RFEF, that decision “was considered absolutely arbitrary and devoid of any legal basis, like others that the TAD had been dictating on previous dates and always along the same lines”, emphasizing that “it had complained about that, both in publicly and privately, the president of the RFEF, Luis Rubiales”.

“Now, the Superior Court of Justice has just completely agreed with the appellants, and resolves the complete annulment of the TAD resolution annulling the 2020 RFEF elections,” he stressed.
