The Administrative Court of Sport has rejected, without going into the merits of the case, the precautionary suspension of the result that occurred in the match between Deportivo and Extremadura for the complaint for improper alignment presented by the Galician club and which was dismissed by the Competition and Appeal Committees.

The Court of Arbitration for Sport explains in its ruling, to which EFE has had access, that “agreeing to the request for the precautionary measure sought” by Deportivo “would suppose an anticipated, although not definitive, estimate of the underlying claim” and it would translate into an “anticipation of the effects of the intended positive opposite act” by the club from A Coruña.

Dépor asked for the precautionary measure because it considered that, “if the decreases and promotions of the 2019-20 season were applied, irreversible legal situations would be created, rendering ineffective the estimatory resolution that could fall on the present appeal and making it impossible to comply with it on their own behalf. terms “.

The TAD, which in this resolution does not debate the merits of the matter, considers that The precautionary measure requested by Deportivo cannot prosper, because adopting it would mean “reversing the results of promotions and descents currently planned, altering the principle of competition, and may prejudice the general interest of the competition.”

Deportivo went to the TAD after their complaint was dismissed by the Competition and Appeal for improper alignment of Extremadura in the match of the penultimate round (2-3) at the Abanca-Riazor Stadium.
