The LNFS challenges the modification of the RFEF Regulation before the CSD for seeing it unconstitutional

The National Futsal League (LNFS) has announced this Thursday that it has challenged before the Higher Sports Council (CSD) the modification of the General Regulations of the RFEF that was approved last Monday, arguing that it violates the constitutional right of the clubs to free association.

In a statement, the organization announces that it has taken this measure because the regulation approved by the Delegate Commission of the General Assembly of the RFEF last Monday 25, according to what they assure, goes against article 22 of the Spanish Constitution and article 87 of the status of workers

The LNFS qualifies the changes introduced as “unilateral, arbitrary and unjustified modifications, manifestly contrary to the legal system, to the extent that they involve inadmissible interference in the rights of the clubs themselves, in addition to excesses of the powers entrusted to the RFEF by virtue of Law 10/1990, of October 15, on Sport and Royal Decree 1835/1991, of December 20, on Spanish Sports Federations”.

The association affirms that “the RFEF sets itself up as the exclusive representative of the clubs that participate in non-professional competitions, imposing on them, without the possibility of their own choice, their recognition as exclusive representative and demanding, as a prerequisite to the signing of collective agreements, a report of a mandatory nature, curtailing their absolute freedom to act on their own behalf and in defense of their interests”, in relation to the new section added to art.22 of the General Federal Regulation.

In addition, the LNFS maintains that these changes violate current sports legislation and describe them as an “excess of the functions that the RFEF has entrusted” since “the condition of exclusive and exclusive representative of the clubs is arrogated, cutting off their free ability to choose and making clear the required condition of impartiality”.

For the LNFS, the federation’s way of acting also violates article 7 of the Constitution, which recognizes the defense and promotion of economic and social interests in workers’ unions and business associations in a behavior that they describe as “new nonsense raised by the RFEF”.

“It is obvious that the RFEF is not a company, nor does it have the legitimacy to intervene on behalf of the clubs in any negotiating commission, as it is not constitutionally or legally legitimized to do so, violating the clubs’ right to collective bargaining, also interfering in their freedom of enterprise”, he adds.

Finally, the LNFS regrets that, “once again”, the body chaired by Luis Rubiales “despises and undervalues ​​the clubs, reducing their condition to mere collecting entities and objects” to which “it separates any decision or provision regarding the defense of their own rights and interests.
