The investigating judge proposes the descent of Fuenlabrada

If yesterday Friday all afternoon LaLiga announced that it was rejecting a Second of 24 teams without contemplations, today it was the turn of the RFEF. In the morning, The Competition Committee rejected Fuenlabrada's request to challenge the investigating judge in the case, this afternoon he announced his proposed sanction. It is forceful and in it proposes the “descent of Fuenlabrada for very serious conduct with a penalty of 15,001 euros and the penalty consisting of the demotion”.

The RFEF examining magistrate's order is extensive, with 45 pages in which the facts are related, the infractions are exposed and the conclusions are detailed. It divided into 87 different steps everything that happened from July 20 to today, detailing everything that happened since the arrival of Fuenlabrada in A Coruña. The testimonial evidence and the actions of Fuenlabrada, Xunta, A Coruña city council, Community of Madrid and LaLiga are also provided. This proposal of the examining judge must now be studied by the Competition, which will be the one that gives validity or not to the sanction proposal. The term to appeal will be ten days.

Therefore, the investigating judge concludes “To sanction CF Fuenlabrada, SAD for the commission of a disciplinary offense for conduct contrary to good sports order of a very serious nature typified in article 68.1 of the Disciplinary Code with a fine of 15,001 euros and the sanction consisting of a demotion”.

Minutes after announcing the sanction proposal of the investigating judge, Fuenlabrada issued a statement insisting that “The appointment of Ricardo Esteban Díaz Sánchez as Instructor is illegal” since “he was not appointed by season, but was appointed an Instructor Judge of the RFEF the same day that the case against CF Fuenlabrada was assigned to him”. The Madrid club has been trying for weeks to challenge the investigating judge in the case, but its claim has been rejected up to two times.

Fuenlabrada also assures in its statement that it is calm in the face of this sanction proposal: “The Competition Committee did not consider that there was conduct even for the provisional loss of three points, so it is technically impossible for it to consider that it could reach the absolute madness of an administrative decline. We live in a rule of law in which public authorities that abuse their power in an illicit way are faced with specific types of the Penal Code “.
