The CNMC reviews the proposals of the RFEF to market the TV rights of the Cup and the Super Cup

The National Commission for Markets and Competition (CNMC) has approved two reports in which it analyzes the conditions proposed by the Royal Spanish Football Federation (RFEF) to market the audiovisual rights of the Copa del Rey and the Super Cup in Spain and Andorra .

A previous version of the conditions for these tenders had been previously analyzed by the CNMC. In a statement, the CNMC favorably values ​​the opportunity to issue a new report on the modified conditions in compliance with the Royal Decree of April 30, 2015 on the centralized sale of television rights for professional football.

In these reports, the CNMC focuses on the aspects that have changed with respect to the conditions previously reported. For the rest of the elements, it refers to the previous reports.

In particular, the CNMC recalls its unfavorable assessment of the inclusion of powers, reservations or ownership of rights not attributed by the 2015 Royal Decree-Law and of the unjustified restrictions relating to the advertising decisions of the successful bidders.

Regarding other changes introduced in the conclusions, the CNMC favorably considers in the Cup the option of splitting Lot 1, with the main parties, into 2 possible options, to increase the potential interested parties.


Likewise, it considers positive that it is tendered for a maximum of 3 years in the Copa del Rey, a limit that already existed in the Spanish Super Cup, that the reserve price becomes known to the interested parties, and unfavorable that the discretion of the the RFEF when proceeding in one way or another for the tender in the event that the reserve price is not reached, without explaining the criteria for one or the other decision.

In general, it favorably values ​​the greater precision of the specifications in certain aspects that had been indicated by the CNMC. These reports are issued by virtue of article 4 of the Royal Decree-Law of 2015 on urgent measures in relation to the commercialization of the exploitation rights of audiovisual content of professional football competitions.

This requires trading entities to request a prior report from the CNMC on the proposed conditions.
