CBS Sports sources report that an NCAA regulation that increases the likelihood that Jim Harbaugh will be charged for major NCAA violations is central to the coach’s agreement with Michigan.

Harbaugh would face charges for a Level I violation under the NCAA’s coaching responsibility provision if a member of his staff is found to have committed one. This provision was strengthened on January 1, 2023, just a few months ago.

The charge is beyond dispute; nevertheless, the NCAA Committee on Infractions may deliberate on the gravity of the sanction.

Regardless of Harbaugh’s oversight, compliance, or diligence with the matter, the level I find would persist in his record.

While contemplating his future at Michigan, Harbaugh has undergone interviews with a minimum of two NFL clubs.

According to senior NFL analyst Josina Anderson of CBS Sports HQ, Harbaugh reportedly initiated discussions with the Los Angeles Chargers on Tuesday to become their head coach.

Because of the modified rule, Harbaugh’s representatives are petitioning Michigan for immunity that would shield the coach from termination for such infractions.

According to reports, the parties have been deliberating on a record-breaking contract extension worth $11.5 million annually, amounting to nine figures.

The main concern at hand is the contract’s “strict liability” clause concerning termination for “cause.”

It is common for contracts to stipulate that universities may terminate coaches for cause in the event of NCAA violations.

However, the modification of the coaching responsibility bylaw has perturbed Harbaugh’s squad.

On November 3, Stallions tendered his resignation after being accused of violating NCAA regulations by operating an illicit scouting program, which involved videotaping indicators of prospective opponents in the Big Ten and College Football Playoffs. The extent of the Stalions’ cooperation with NCAA investigators remains unknown.

The previous understanding of the statute attributed liability to the coach, and a coach could have the finding reduced or dismissed by demonstrating adherence to NCAA regulations. The revised interpretation from January of last year renders a violation of this provision irreparable.

Harbaugh’s legal team is concerned that the language may automatically trigger a Level I charge towards the coach, resulting in his dismissal due to an employee’s misconduct.

Last week, Yahoo Sports reported that Harbaugh requested the Wolverines not to fire him in the event of NCAA violations.

Likewise, Yahoo reported that Harbaugh’s representatives exerted pressure on the new contract to contain a provision mandating the submission of all disputes regarding NCAA violations to a three-member judicial panel.

The Infractions Process Committee of the Division I Boards of Directors executed the coaching responsibility modification to streamline NCAA cases. Greg Sankey, the commissioner of the SEC, leads the committee.

The notion that coaches would seek protection from NCAA findings is not unheard of. Bill Self, the basketball coach for Kansas, included language in his contract. This safeguards him against termination due to serious NCAA infractions.

One of Harbaugh’s attorneys, Thomas Mars, stated on social media that, as a consequence of the new rule, every coach in the nation will soon seek comparable protections.

“I received an extension even if the schools stipulate in the contract that you will not be held liable for it,” said Kansas City, Missouri-based sports law attorney Jason Montgomery. “This is the subsequent version of that.”

The NCAA is also conducting an investigation into Harbaugh and Michigan for alleged recruitment violations that occurred during the COVID-19 dormant period. Nevertheless, this inquiry was initiated before January 1, 2023, commencing in 2021.

In this case, Harbaugh is allegedly guilty of a Level I offense for deceiving investigators. The NCAA has provided its assessment of Harbaugh’s responsibility in the recruiting controversy.

Derrick Crawford, vice president of the NCAA, stated the previous year that the violations were “not a cheeseburger” in light of their gravity.

The NCAA has faced prior criticism for initiating legal proceedings over comparatively trivial infractions, such as furnishing a meal to a prospective recruit.

To compound the situation, the sign theft case is regarded as one of the initial, if not the inaugural, cases to incorporate the modified regulation regarding increased coach responsibility. The NCAA prohibits participants from commenting on ongoing cases that it cannot address.

The infractions committee at Michigan discarded the negotiated resolution in August, which proposed imposing a four-game suspension on Harbaugh in light of the recruiting investigation.

The committee emphasized the need for a comprehensive investigation into the case. To reduce penalties, Michigan afterward imposed an eight-game suspension on Harbaugh to commence the 2023 season.
