LaLiga warns clubs by letter: bonuses are already a crime

In its obsessive and firm persecution of cheats and ensuring the integrity of the competition in Spain to end corruption in sport, LaLiga is sending a letter to the footballers, managers and employees of First and Second in this antepenultimate round to remind them of the ban on “Conducts tending to predetermine or deliberately and fraudulently alter the results”, also refreshing the memory of prison terms already contained in the Penal Code.

The letter in question, dated July 10 and signed by the director of Integrity of LaLiga, former police officer Florentino Villabona, The jurisprudential doctrine established by the recent judgment of the Provincial Court of Navarra of April 23, 2020, which LaLiga has assumed as its own, is made available to professionals, which it estimated that “The payment of bonuses to third parties, even when they are intended to encourage the victory of the primate team, constitutes a crime of sports corruption typified in article 286 my 4 of the Penal Code.” And adds: “It provides for penalties of up to four years in prison, a fine of up to three times the value of the amount received and special disqualification for the exercise of the corresponding position for a term of up to six years.”

The LaLiga missive has been distributed by all levels of the clubs since, according to the text, the crime is “capable of being committed by a wide range of subjects, from players to managers or employees”, and “It is a crime of early consummation, that is, the mere offer of the premium is already a crime without it being necessary to consummate the payment thereof.”
