LaLiga contracts cannot include any mandatory covid vaccination clause

Next Monday concludes the winter market in UEFA, thus closing the window that allows clubs in Europe be able to strengthen for this final stretch of the season. Starting with the Spanish league. A market that has coincided with the sixth wave of the coronavirus under the name of Omnicrom. There are many cases of players, especially weeks ago, who have been affected by this most infectious variant.

Situation that legally in no way affects the contracts that the players sign on the occasion of this January window. As he has learned the Sports world, the new contracts that footballers in our league are signing these days, can say nothing about compulsory vaccination.

Nor in terms of the requirement to have it for those players who are now joining our league, such as the obligation to obtain full vaccination.

According to expert sources on this matter consulted by Sports world, no club can include this mandatory clause because it clearly violates the individual rights of the footballer.

We must start from the current scenario that exists in our country where vaccination is not mandatory. There is no organic law that urges Spanish citizens, including footballers, in this regard.

Moreover, in the guidelines that the League sent to the clubs at the beginning of the season, it recommended that they communicate whether the players were vaccinated or not. But it was not obligatory in this respect, considering the national legislation.

Moreover, in the latest protocol of COVID updated on January 4, urges clubs to report cases that appear in their teams. But it does not oblige at any time to give the name of the players, coaches or remains of the coaching staff that could be affected. And it does not force it because legally they cannot. According to these same data, about 95% of professional soccer players in our country are vaccinated and only 5% have not received that first vaccination schedule.

Then, in the contract models that are currently being signed, the clubs can make available to the player or professional the option of being able to get vaccinated, recommend him about it, but never include it as an obligation because, as we say, it violates the freedom of the person and more so in our country where the vaccination schedule is not required of anyone as a citizen. And the non-existence of a national law disables any option at the level of a private institution such as a club or SAD. Neither in new contracts and less in existing ones.
