LaLiga charges hard against the instructor of the “Fuenlabrada Case”

LaLiga, in an informative note, has criticized the instructor who has proposed the descent of Fuenlabrada for his displacement to La Coruña for the league match against Deportivo on July 20 and, in general, the file that he has drawn up and whose “outcome”, in the opinion of the employer, “was predetermined from the first moment”.

LaLiga explains that in the document written by the instructor of the Spanish Football Federation it is observed that “a series of facts are hidden and data is deliberately ignored.”

“It is full of tortuous statements, half-truths, if not falsehoods, all with a single purpose to create an artificial story that supports the true objective: to alter the competition and the results of Laliga SmartBank”, maintains the association of clubs.

It also ensures that in order to “achieve this objective, he has not showered in proposing at the last minute to the Competition Committee an instructor lacking experience in the world of sports law, which the same day he was appointed appeared on the RFEF website “.

“All of this,” adds LaLiga, “so that the current deputy secretary general of the RFEF, Miguel Garcia Caba, is the drafter of most of the orders and even the provisional measures, as demonstrated in the expert opinions presented by Laliga. “

He argues that, “as is logical, this fact discredits the procedure, vitiates it from the first moment, gives it overtones of nullity, is against the law and shows that its outcome was predetermined from the first moment.”

“This action discredits Mr. García Caba as a professional and, of course, it will be brought to the attention of the relevant bodies, “says the body chaired by Javier Tebas.

He adds that “the 'alleged instructor' throughout the writing reveals an absolute and disconcerting ignorance of the regulations on which the competition was being developed “.

“In a complex and complicated moment the 'Protocol of Return to the Laliga Competition' was drafted and endorsed by the administration, later the CSD (Higher Sports Council) approved its own and, both are subject to sanitary regulations”, sustains LaLiga.

It also points out that “all these documents claim that the competition is played with the maximum sanitary guarantees and preserving the integrity of the competition at all times “.

“With them Equipment components are protected, encapsulated and any contact between them with external personnel is avoided. And so it has happened, the approved protocols have been scrupulously complied with as it shows that no one outside the club has suffered any contagion, “justifies LaLiga.

It affects that “The alleged instructor is also surprised by 'the proactive defense and fervent defense of the interests of CF Fuenlabrada'” and LaLiga says that what he has done is “defend the competition and that there is no alteration of the results of the same with a clear violation of current regulations “.

“You are not defending CF Fuenlabrada, you are defending the competition and its integrity, which is, without a doubt, the supreme value that should preside over all the acts of the institutions that organize sports competitions and even more so in the professional sphere “, he says.

The employer affirms that “CF Fuenlabrada, like the rest of the teams that make up the competition, followed the instructions emanating from Laliga at all times “.

“What's more, the Madrid team did not take any decision on its own during the weekend in which the events analyzed took place. All the decisions of any kind taken on those days were La Liga decisions seconded by CF Fuenlabrada, “he says.

He also maintains that “On top of the ineptitude of the alleged instructor, alleged responsibilities of Laliga are pointed out.”

“Well, during the investigation the statement of the people who participated in the decision-making was admitted as evidence and said evidence was never carried out, despite having had all the time necessary to be able to perform “, assures the employer.

“No one from LaLiga has deigned to answer the entire procedure in writing, and it should not be forgotten that it is the organizer of the competition and, as such, you must defend the integrity of it. Because, if LaLiga has so much responsibility, why hasn't the test, admitted by him, been practiced? “

He also criticizes that “as a culmination of the absurdity of the file is the proposal that is made” and questions: “Does anyone in their right mind believe that CF Fuenlabrada's relegation request is subject to law?”

“Is it fair that a team, by scrupulously following the recommendations of its association, is demoted? What sports justice parameters have the instructor and Mr. García Caba used to make this proposal? Are the proposals of the League of 24 coincidences at times that coincide with the most important milestones of this disciplinary procedure? “, He asks.

LaLiga concludes that “it has defended, defends and will defend the competition and its integrity, in all its aspects regardless of the affected club or the victim and regardless of which institution or persons are the protagonists of the attack.”

It points out that “in defense of the competition it goes as far as necessary” and, finally, it states that “it is surprising that the alleged instructor forgets in his resolution the attempt to manipulate a test by a club”, without alluding to anyone, but in reference to Deportivo.

“We imagine that, as it is his obligation, he will have reported the irregularities produced to the Public Prosecutor's Office,” the employer ditch.
