Fuenlabrada's complaint against Rubiales and the Federation admitted for processing

He Fuenlabrada has communicated that andhe Criminal Investigation Court No. 4 of Majadahonda has admitted the complaint filed by the Madrid club against the president of the RFEF Luis Rubiales, the general secretary of the RFEF Andreu Camps and the RFEF investigating judge Ricardo Esteban Díaz Sánchez.. Last September 3, the court opened investigation proceedings to investigate the possible illegalities committed in the disciplinary file 562/2020 of the RFEF against CF Fuenlabrada SAD.

Fuenlabrada statement

“CF Fuenlabrada SAD has provided the court with solid evidence of illegalities in the disciplinary process that involve federative managers in an illegally coordinated strategy, which among other issues involved:

– The appointment of Ricardo Esteban Díaz Sánchez as Investigating Judge of the RFEF “coincidentally” hours before the file was opened against CF Fuenlabrada SAD, when as a rule the investigating judges must be appointed for sports seasons (crime of illegal appointment 405 and 406 CP).

– But in addition, the illegally appointed investigating judge was not the real author of his writings, but rather they were drawn up from the RFEF general secretary, violating the duty of independence and exposing the interests behind the disciplinary file (crime of documentary falsity 390, 391, 392 CP).

– From that same general secretariat that usurped disciplinary functions, letters were sent to LaLiga in exact coincidence with the progress of the disciplinary file that they themselves managed underhand, insinuating that if LaLiga did not take certain measures at their convenience, they would go for administrative descent of the CF Fuenlabrada SAD (whom I put in copy in case there is any doubt). These communications being totally coercive, threatening, inappropriate for an institution like the RFEF and of course proof that the disciplinary process did not have the minimum guarantees of objectivity and independence.

All of the above, added to the manufacture and acceptance of false evidence and multiple procedural abuses, must be thoroughly investigated in this criminal proceeding, since it is not acceptable that the RFEF manipulates a disciplinary file in such a serious way. What has happened to us today can happen to anyone tomorrow. “
