Final victory of Antonio David Flores against ‘Save me’: his dismissal was void and La Fábrica de la Tele must compensate him with 120,000 euros

La Fábrica de la Tele, producer of Save memust indemnify Antonio David Flores with 120,000 euros after the Supreme Court has firmly declared that his dismissal from the program was null.

The Social Room has rejected the appeal of the producer for processing of the Mediaset program against the ruling of the Superior Court of Justice of Madrid (TSJM) that confirmed the annulment of the dismissal of the talk show host for violation of the right to honor. The Chamber, collects EFE, explains that “the difficult quantification of moral damage justifies that it must be compensated when the violation of the fundamental right is requested and proven.” And he stresses that the producer’s allegations are “unacceptable” to study the appeal, which is why he follows the prosecutor’s criteria to reject the appeal for not meeting the legal requirements, so that he orders the costs.

The legal battle between Antonio David and La Fábrica began when this company terminated its contract after the premiere of Dew. tell the truth to stay alive. It must be remembered that Antonio David was on the staff of collaborators of Save me until the moment in which these episodes began to be broadcast. The producer, even being aware of Rocío’s testimonies in the documentary that they were preparing for months, did not make the decision to fire him before her.

“After the broadcast last night of the first two episodes of the documentary series Rocío, telling the truth to stay alive, Sálvame announces today, March 22, 2021, the termination of Antonio David Flores’ employment relationship with this television program, as well as with the production company La Fábrica de la Tele. Mediaset has also extended this measure to the rest of the audiovisual group’s programs”, announced Carlota Corredera a day after the premiere of the docuseries.

120 euros in compensation for Antonio David Flores

The Social Court number 42 of Madrid already determined in September 2021 that “the dismissal of the worker is void for violation of his fundamental right to honor.” The producer was then sentenced to indemnify 32,361 euros for the payroll that she stopped receiving due to the assignment of her temporary contract and 50,000 euros for the violation of her right to honor. The magistrate also pointed out that “it seems a risk to point out Antonio David with the word abuser because there is no sentence.”

In May of last year, a new ruling by the Superior Court of Justice of Madrid quantified the moral damages at 120,000 euros, 70,000 euros more than previously ruled.
