FIFA will have to pay Pablo Silva and Haine Allemagne, creators of the aerosol used to mark the distances of the barriers, an amount of more than 120 million euros, according to AS has learned. This amount is the result of the 40 million euros that Blatter, former president of FIFA, agreed with the inventors of the spray before the 2014 World Cup in Brazil and the sum of the fines and interest after seven years of litigation for non-compliance of that agreement by the following leaders of the organization, with Gianni Infantino at the head (in 2017 a Brazilian court imposed a fine of 15,000 euros for each game in which the spray was used).
The ruling of the Civil Chamber 14 of the Court of Justice of Rio de Janeiro was the one that last Tuesday ordered FIFA to pay compensation to Silva and Allemagne for “having acted in bad faith and having improperly appropriated their invention”, sAccording to the judicial sentence to which AS had access. The ruling was unanimous (three votes to zero). “We are very happy, in shock because two simple individuals like us have knocked down a giant like FIFA”, a Silva assures exclusively to AS a few hours later he was still excited about having put an end to seven years of lawsuits and claims.
Silva and Allemagne reached an agreement with former FIFA leaders Julio Grondona and Joseph Blatter in 2014 for the use of the aerosol in exchange for 40 million dollars, but after the FIFA Gate scandal and the death of the Argentine president, all communication with the body, which with the new directive, used the spray without complying with the agreement. After a first lawsuit prior to the 2018 World Cup in Russia, a Brazilian judge banned the use of the aerosol, but FIFA also used it under the name of another brand.
