Alves' statement has been a long time coming. So much so that journalists and courtroom assistants suspected that it could be postponed to this Thursday. Finally, late in the afternoon, the Brazilian testified in front of the magistrate and ratified his last statement (the fifth), in which he assured that on the night of December 30, 2022, he acted under the effects of the alcohol: “I had drunk three bottles of wine and a half of whiskey”, has said. Some words that respond to the strategy set by the defense, which intends to use alcohol as a mitigating factor in the crime, and which Bruno (Dani's best friend, who testified on Monday) and his wife Joana Sanz also insisted on: “When he arrived home reeked of alcohol, he crashed into the table and collapsed on the bed,” he said Tuesday.
This Wednesday, Alves insisted that he did not sexually assault the 23-year-old girl at the Sutton nightclub: “It was consensual sex”, he assured. She claims that the girl's attitude was complicit and friendly at all times, she even “twerked” with him before he invited her to go to the bathrooms.
The former FC Barcelona player is accused of alleged sexual assault. The events occurred on December 30, 2022 at the Sutton nightclub in Barcelona, when he was out partying with friends. He met some girls and invited one of them into a bathroom where, according to the victim's statement, he forced her to have penetrative sex. He provided, as evidence, statements from witnesses (such as the Mossos or the nightclub staff), the medical report and images from the establishment's security cameras.
Alves, for his part, gave up to five different statements: in the first, he denied even knowing the girl. In the last one, he alleges that he had “consensual” relations and that he was acting under the influence of alcohol. He has been in preventive detention for 13 months in the Brians II prison and faces a sentence of nine years in prison, in addition to compensation of 150,000 euros to the victim that he has already deposited in court.
The Brazilian enjoyed an excellent financial situation after decades in the sporting elite, but his problems with the law have generated a significant outlay, mainly due to the fees of the different lawyers who have defended him so far. Furthermore, it must be remembered that The Pumas of Mexico terminated their contract with the footballer a few days after the scandal came to light, so Alves has not received any salary for more than a year.
The lawyer provided a certificate on Monday to demonstrate that his economic capacity has been reduced after being accused of such a serious crime.
