Chamber II of the Supreme Court (TS) has confirmed the sentence of 4 and a half years in prison imposed by the Provincial Court of Seville on Eduardo Fernández Triviño for misappropriation of 780,000 euros of the assets of the Betis footballer Joaquín Sánchez while he was his administrator between 2003 and 2007.
In the ruling, dated December 17 and to which Europa Press has had access, the high court also confirms that Fernández Triviño must compensate, in terms of civil liability, with 255,900 euros to the player and with 525,000 euros to a company of the that Joaquín was the sole administrator.
The Supreme Court dismisses in its entirety Fernández Triviño’s appeal against the judgment of the Seville Court, of July 25, 2019, which convicted him of a continuing crime of misappropriation. The ruling considers it proven that the former administrator “used the trust” of the Betic footballer, who “did not demand accountability, or delivery of receipts or payment documents or proof of expenses or amounts provided”, until Their relationship ended in 2007.
In the same ruling, the Supreme Court partially upheld the appeal of the wife of Fernández Triviño at the time of the events, María de los Ángeles Lorca. Thus, it maintains, as did the Seville Court, that it was a lucrative participant in the crime of its spouse, but it reduces the civil liability that corresponds to it to 176,000 euros.
This is the money that, according to the account of proven facts, was used in the acquisition for the joint community of the marriage of a house located in the Malaga town of Marbella, on February 27, 2006, and that was paid in cash and without need for any financing.
