Borja Thyssen-Bornemisza And his wife, Blanca Cuestathey will sit on the bench on February 14 accused of defrauding the Treasury of 336,417 euros in 2010. The Prosecutor’s Office asks for each of them three years in prison and that they pay a fine of one million euros.
Legal sources have informed EFE that this is the date initially set for the trial, which will be held in Criminal Court number 15 in Madrid.
According to the Public Ministry, both declared that in 2010 they had a capital gain of 2,206,527 euros from the sale of some social shares, when the actual gain obtained was 3,792,564 euros because they simulated that part of the transaction corresponded to a company that in reality it was inactive, “thus hiding the amount of 1,586,037.39 euros from the Public Treasury”, and ceasing to pay the 336,417 euros.
The Public Ministry reports that on February 26, 2010, the sale of the shares of Cas Capetó SL took place by Borja Thyssen (owner of 50 percent), Blanca Cuesta (40 percent) and the company Caribean Breeze SL (10 percent ) to the Dutch Princess Four BV, Hermosa Beach Holding BV and Martínez Investments BV
The Prosecutor’s Office explains that the assets of Cas Capetó SL consisted mainly of a house in Ibiza, which lacked hired personnel and without any economic activity, and that the total price paid for said operation amounted to 9,700,000 euros, which were deposited in the bank account owned by Borja Thyssen-Bornemisza.
Both defendants, who submitted the income tax return for the year 2010 in its joint tax modality, declared that this sale gave them a capital gain of 2,206,527 euros, hiding 1,586,037 from the treasury. The concealment also comes from the sale of shares carried out through Caribean Breeze SL, which is an “inactive company”, says the Prosecutor’s Office.
For the Public Prosecutor’s Office, the inactive company was filed by the defendants when they acquired the shares of Cas Capetó SL in 2005, and stresses that “the acquisition of the shares of Cas Capetó in this way constituted a simulated legal transaction, the real business wanted by the parties the acquisition by Borja Thyssen of 57 percent of this company and by Blanca Cuesta the remaining 43 percent”.
He insists that neither of the two defendants paid it in their 2010 income statement “guided by an intention to obtain an illegal tax benefit.” The prosecutor emphasizes that Borja Thyssen made a transfer to Cas Capetó but then received a series of goods and services that should have been taxed as compensation in kind, “which he did not do.”
Since they got married in October 2007, Borja and Blanca have been the parents of five children: Sachathirteen years old; Ericeleven; Enzoof nine; Kalasix years old and the little one India, fingers.
