Barça and the 'apocalypse' of the Bankruptcy scenario

As reported last Friday night by RAC-1, Barça could enter bankruptcy next January if it does not reach an agreement with players and club employees to achieve a cut of about 190 million euros in salaries before November 5. The key to entente, obviously, is not the regular workers but the footballers. As AS learned, the contest option is possible, but that scenario is almost apocalyptic. First, because there is a first intermediate step, the pre-contest or prior communication, which is a scenario provided for in the Bankruptcy Law that allows the debtor who is in a state of insolvency, in this case it would be Barça, to extend the period in which legally You are obliged to request bankruptcy, as long as you are negotiating with your creditors an advance agreement proposal. In this scenario, the club is not in a bankruptcy administration scenario (that is, intervened) even though it has defaults.

Second, because if a bankruptcy process is approved, Barça would only obtain deductions with the creditors it has so far and would not resolve the money that it will continue to owe to its players with the salary adjustment. Its operation as a club, in addition, would be completely irregular and even exposed to the possibility of an ERE affecting the players.

The players' lawyers sat at the negotiating table for the first time on Friday with good will. In fact, four players, Ter Stegen, De Jong, Lenglet and Piqué, one of the captains, have already signed a contract extension that, these days, Coutinho, Griezmann, Sergi Roberto, Jordi Alba or Sergio Busquets are also negotiating. The resignation of Josep Maria Bartomeu and his Board of Directors has helped to start a period of relaxation after the letter that the players sent in their day protesting the ways in which the club had communicated the obligation to cut their salaries or, well , postpone them until regular income is recovered. Barça has calculated that, in the best of cases, it will enter 231 million euros less this season.
