A case against punt Matt Araiza for rape was dropped.
Matt Araiza, a former punter for San Diego State and the Buffalo Bills, has been dropped from a case that claims he raped a 17-year-old girl at a off-campus party in October 2021. He reached a deal with the girl, who has been named Jane Doe.
Doe dropped Araiza in the August 2022 case, and Araiza agreed to drop a July 2023 defamation suit against Doe. ESPN got a copy of the deal and read it.
Doe can still bring the suit towards the four additional named defendants, who used to play with Araiza at San Diego State. There is no exchange of money in the settlement deal.
Araiza also has the right to sue Dan Gilleon, the plaintiff’s lawyer, and his law office, and he has hired a lawyer to do so. His lawyers stated that Araiza has every plan of going back to the NFL to play football again.
In a statement, Araiza’s lawyers, Dick Semerdjian as well as Kristen Bush, say that Araiza continually stands by his innocence and regrets the time he wasted defending himself on false charges.
“Thankfully, there was extensive evidence that proved to be key to securing Matt’s voluntary dismissal to this lawsuit,” said the statement. Matt was and always has been good. Now that the case is over, Matt has won.
The Bills released Araiza on August 27, two days after the case was filed. The Bills had picked Araiza in the sixth round in the 2022 NFL draft. In May, the New York Jets brought him in to work out.
The claim said that Araiza, who had been 21 at the time, took Doe to the other side of the house as well as told her to have oral sex with him before they got sexual.
The claim says that Araiza then took her inside the house, where she met at least three other men who raped her over and over for about an hour and a half.
The girl told the San Diego Police Department about the claimed rape the next day. The police looked into the claims for nine months before handing them over to prosecutors on August 5, 2022.
Witness statements that were part of the evidence that led to charges not being filed showed that Araiza was not present at the time of the claimed gang rape.
For his part, Araiza said that they had sex outside their home earlier that night and that he never went inside. Police in San Diego said on December 7, 2022, that they would not be filing any formal charges in the case.

“Thank goodness there was a lot of evidence which was key to getting Matt to voluntarily drop this lawsuit,” the statement said. Matt was and always has been good. Now that the case is over, Matt has won.
The woman, whose name was only given in court papers as “Jane Doe,” was sued for defamation.
The lawsuit was “legally baseless,” but her first bill was over $20,000, and her lawyer, Dan Gilleon, told the San Diego Union-Tribune that she “simply cannot afford an attorney for herself.”
