The legal consequences of the signing of Neymar Jr. by Bara do not cease even seven years after being agreed. Santos, former team of the Brazilian striker before being transferred to the Barca club, has sent a burofax to FC Barcelona in which he claims 4.5 million euros as a criminal clause signed in the signing, as a result of the breach of the Hold an agreed friendly match. Specifically, the Brazilian club considers that Bara owes him this amount since two friendly matches are included in the signing with the presence of Neymar between the two teams, but only one was played, the 2013 Joan Gamper Trophy, only about months after the arrival of the striker, who finished with an 8-0 victory for the then team to lead the Tata Martino. The second must be played in Brazil but it never took place.

Therefore, Santos has placed his claim in the hands of the law firm Vosseler Abogados that has sent the claim as a preliminary step to start the court. Judicial sources indicate that in recent years the Brazilian club has requested by letter to Bara to pay this money. Precisely, in the sent burofax, signed by the lawyer Leire Lpez, indicate that there have been innumerable attempts by my client to comply with the agreements reached, so without further delay, the execution of the claim of the criminal clause established, while the breach is completely foreign to the will of Santos Futbole Clube, being attributable to the Ftbol Club Barcelona.

In this sense, one of the conditions of the friendly matches agreed in the signing was the presence of Neymar, an option that vanishes, for the moment, with the march of the Brazilian striker to the French PSG. That is why in 2017, Santos began with his petition of 4.5 million by letter to Bara and by not getting an answer as they hope they have started the claim before filing a lawsuit in court.

Precisely, after signing the signing for the Parisian club, Santos announced that he will ask for payment of some 13.4 million euros to Bara and PSG for the transfer. The Globoesporte portal indicated that Santos claimed a percentage of 5% of the signing of Neymar, about 8.9 million euros plus 4.5 million for the breach of Barcelona by one of the two friendly matches agreed when they signed the striker . The Brazilian team's director considers this amount claimed as compensation for not contesting the missing match.

In the burofax sent at the end of January, Santos' lawyers gave the Bara five days to pay the amount claimed before taking whatever legal action corresponds and detail that Santos has already duly remitted the invoice with the amount due. They also indicate that they will ask Bara for all judicial costs of the requested claim if the lawsuit is initiated in court.

It is not the only legal confrontation that Bara and Neymar have as protagonists because of the signing of the striker by the Barca club. Last June, the National Court agreed to send the open cause to the courts of Barcelona for crimes of corruption between individuals and fraud due to a complaint by the company DIS, which owns a part of the player's rights. The soccer player, his parents, the president of FC Barcelona, Josep Mara Bartomeu and the former president Sandro Rosell are being prosecuted since the magistrates considered that the possible crimes “were committed in Barcelona, a city where the deceptive criminal strategies and behaviors that they gave were deployed place to the commission of those, place from where the patrimonial displacements took place “.

The trial may be held this year even though it is not yet indicated. On the bench will sit the player, his relatives and executives of Bara and Santos, in addition to both clubs as legal persons and the family business of the striker, N&N Consultora, for his alleged maneuvers to inflate the cost of signing up to 83 million Euros La Fiscala asks for 2 years of prison and 10 million euros of fine for the player, two years for his father and one for his mother for the crime of corruption in business, 5 years of imprisonment for Rosell and 8.4 million euros fine for Barcelona and 7 million for Santos.

In 2016, the Audiencia de Barcelona already prosecuted the alleged fraud of 13 million euros in the signing of Neymar, although Bara admitted the tax offense and was sentenced to pay five and a half million euros.
